What is Europa?
An EU Authorized Representative (or European Authorized Representative) is a natural or legal person expressly designated by a manufacturer located outside the EEA (including the EU and EFTA). The natural or legal person may represent the manufacturer outside the EEA in the performance of specific duties required of the manufacturer by the relevant EU directives and laws.
- The New Methods Directive requires that the EU Authorized Representative must be located in the EEA and have a commercial registered address;
- The competent authorities of the EEA member states may at any time approach an EU authorized representative to verify that the manufacturer abroad has fulfilled the duties required by the relevant EU directives and laws;
- A manufacturer's general commercial representative (e.g. an authorized distributor), whether located in the EEA or not, should not be confused with an authorized representative of the EU;
- Although an EU authorized representative may act on behalf of a manufacturer outside the EU to perform specific duties required of that manufacturer under the relevant EU directives and laws, the manufacturer remains the party with the primary responsibility.
Common Translation Usage
The standard terminology used by the European Union Authorized Representative in the English version of the European Union's Product Directive is (British English) European Authorised Representative, because most of the people who need to designate an EU Authorized Representative are manufacturers located in countries outside the EU, especially the U.S. manufacturers, and the U.S. manufacturers prefer to write the European Authorized Representative in U.S. English as: European Authorized Representative. American manufacturers prefer to write European Authorized Representative in American English.
Since Chinese is not an official language of the European Union, there is no official terminology for European Authorized Representative. In Chinese translations, European Authorised Representative or European Authorized Representative is usually translated as: EU Authorized Representative. It is also translated as: EU Authorized Representative, European Authorized Representative, European Authorized Agent, etc. Often referred to as: EU Representative or European Authorized Representative. Also used: European Union Agent, European Representative, European Agent, etc.. In Taiwan, there is also the use of European Authorized Representative or European Representative.

Duties of Mr. O'Day
1. An authorized representative of the European Union may represent a manufacturer outside the European Union in dealings with customs and governmental authorities in European countries.
2. The name and address of the EU authorized representative of the manufacturer must be clearly printed on the packaging, labels and instructions for use of products imported from outside the EU that are affixed with the CE mark.
3. The European Union Authorized Representative Office must keep up-to-date "Technical Files" of all products affixed with the CE marking to ensure that they can be readily and timely made available to the CE supervisory authority within the European Union for verification. EU law requires that the Technical Files should be retained by the EU Authorized Representative for at least 5 years after the last batch of products is placed on the market.
4. Manufacturers outside the European Union must establish an effective "accident prevention and monitoring system" within the European Union to assist with accident reporting, notification, recalls, etc., through their authorized representatives in the European Union.
5. The authorized representative of the European Union may also be entrusted by the manufacturer to handle product-related registration and application matters.

Why do manufacturers outside the EU need an EU Authorized Representative?
a) According to the legal requirements of the European Union, in order to realize the traceability of the products, the products affixed with the CE marking which are put on the EU market by the manufacturer must be marked with the name and contact address of the manufacturer, and if the manufacturer is from a country outside of the European Economic Area EEA (including the EU and the EFTA), its products must be marked with the name and the contact address of the manufacturer and the authorized representative of the manufacturer in the EU at the same time on the labels (nameplates or packaging). If the manufacturer is from a country outside the European Economic Area EEA (including the EU and EFTA), the product must also bear on the label (nameplate or packaging) the name and contact address of the manufacturer and of the manufacturer's EU authorized representative.
b) In order to ensure that the European Union's competent authorities are able to check the technical file (TCF) of the products affixed with the CE marking in a timely manner, foreign manufacturers should keep the latest version of the TCF with the authorized representative of the European Union for a period of 10 years after the last batch of the products has been exported.
c) Any failure/incident/recall of a product of a manufacturer outside the EU in the EU should be contacted by an authorized representative of the EU for notification and communication with the competent authorities.

How to choose a quality EU Authorized Representative?
a) Select a qualified and competent third party authorized representative company in the European Union.
Legitimate company registered in the European Union / professional technical staff, familiar with EU regulations, able to assist manufacturers in resolving disputes / avoiding shell companies, agents and exhibition service providers.
*The above can be confirmed by checking their EU registration certificate and calling their phone number in the EU to see if it is a recorded call.
b) a valid EU Authorized Representative Agreement or contract.
The name and address of both parties to the contract/agreement must be identical to the name and address of the manufacturer and the EU authorized representative on the packaging/label of the future CE-marked product.
c) The following should be noted:
The terms of the EU Authorized Representative Contract shall be in the main official language of the EU.
Avoiding EU authorized representatives who do not have a fixed place of business and a fixed contact telephone number within the EU.
Avoid Distributors who are also EU Authorized Representatives.
Avoid having relatives and friends studying in Europe who are also EU Authorized Representatives.
