Green Circle Talks Cross-Border] - Compliance Interpretation of EU Market Regulation 2019

As of July 16, 2021, the European Union (EU) Product Safety Regulation ("Market Surveillance Regulation (EU) 2019/1020") comes into force. The regulation requires that a person or company within the EU must be the contact person ("responsible person") for product compliance for CE certified products. These products must be labeled with the contact information of the responsible person. The label may be affixed to the product, the product packaging, the package or accompanying documentation.

The EU has introduced a new regulation, the General Product Safety Regulation (GPSR), which will come into force in December 2024 and sets out the responsible person requirements that apply to most products sold in the EU.

From 2024 onwards, the responsible person information received by each e-commerce platform in the EU will be displayed on the corresponding product details page in order to comply with local regulations.

To ensure compliance with these regulations, the EU e-commerce platforms require traders selling the relevant products in the EU market to provide the platforms with the details of the designated responsible person (DRP). Traders are also required to notify the e-commerce platforms of any changes to the designated responsible person.

Please note that if you do not have a responsible person for your product, it is advisable to contact the Green Circle Designated Responsible Person (DRP) for compliance as soon as possible, as it is an offense to sell CE certified products in the EU without a responsible person. Providing false information about the responsible person is a violation of local laws and regulations. If you provide false compliance information, the EU e-commerce platforms will suspend or terminate your merchant account.
