Green Circle Speaks Out]-California Proposition 65 Alert: Labeling Requirements for Products Containing Harmful Chemical Substances

Recently, a lawsuit was filed in California for violating California's Proposition 65 by selling leather products containing hexavalent chromium. The product in question was leather gloves, and the business was prohibited from selling the product in its unimproved form unless it was labeled with a specific warning. In addition, the business was required to pay $33,000 in costs.

What is California Proposition 65?
California Proposition 65, known as the California Safe Drinking Water and Toxic Substances Mandatory Act (California Proposition 65), was passed in 1986 to protect Californians from chemicals that are known to cause cancer, teratogenicity, or reproductive harm. Since 1987, California has published a list of chemicals that can cause these harms, which is updated at least annually and now includes nearly 1,000 chemicals. Under this bill, all businesses that provide products or services in California must provide "clear and reasonable warnings" about the potential for human exposure to these chemicals.

California's Proposition 65 covers virtually all product categories, including jewelry, toys, appliances, ceramic materials, apparel, cosmetics, and construction materials, and also regulates chemical process byproducts such as automobile exhaust and smog.

Why do I need a test?
Although it may be impractical to conduct comprehensive testing as there are nearly 1,000 substances on the list, risks can be effectively controlled through supply chain investigation and targeted testing. If the hazardous substances contained in the products exceed the limits set in the litigation, enterprises are advised to put warning labels on the products to avoid the risk of litigation.

Warning Requirements:
Under the statute, the main parties responsible for providing product warnings include manufacturers, importers, and so on. Warnings should be provided in such a way as to ensure that they are clearly available to consumers prior to purchase, including by attaching a warning label to the product where it is displayed or by electronic means.
