I. What is Europa?
European Authorized Representative (EAR) is an abbreviation for European Union Authorized Representative, which is a natural or legal person expressly designated by a manufacturer located outside the European Union. The European Authorized Representative assumes the responsibility to perform specific duties on behalf of the manufacturer as required by the relevant EU directives and laws.

Why do we need O'Day?
The establishment of the European representative system is mainly to facilitate the pursuit of product liability. In the event of a safety incident or other liability issue involving a product sold by a manufacturer in the EU, law enforcement authorities can contact the European representative directly, avoiding cross-border communication barriers and allowing for fast and efficient accountability. Therefore, Europcar plays the role of "guarantor", ensuring that manufacturers are responsible for their products in the EU market.

What do I need to do?

  1. Responsible for communication with regulatory authorities in EU countries, handling device complaints, adverse events and recalls;
  2. Keep the technical documentation or CE Declaration of Conformity in accordance with the requirements of the relevant regulations for inspection by the competent authorities;
  3. Registering products in the EU on behalf of the manufacturer and applying for the Free Sale Certificate issued by the EU;
  4. Provide relevant materials such as product packaging, labels and instructions for use, including the EU Authorized Representative logo and its registered address.
    Please note that the above duties may vary according to specific regulations and directives. The specific duties of the EU Authorized Representative may vary depending on the type of product and the requirements of the industry in which the manufacturer operates.

IV. How to achieve compliance?
Merchants need to be aware of and comply with the requirements of the European Union's Goods Safety Regulation (known as Market Regulation (EU) 2019/1020), which requires a responsible person in the EU for the sale of goods bearing the CE marking in the EU. In order to ensure that products sold in the EU market are compliant, merchants need to comply with the following steps:
1. Understand the applicable product range
All products bearing the CE marking require the appointment of an Authorized Representative (AR) in the European Union. These products include, but are not limited to, toys, electronics, personal protective equipment, machinery, construction goods, gas equipment, recreational and private boats, pressure vessels, and measuring equipment, etc. CE-marked goods are subject to EU regulations and manufacturers must appoint an Authorized European Representative (AEUR) to fulfill their responsibilities.
2. Identification of persons responsible within the EU
Merchants are required to appoint an appropriate EU-based responsible person, i.e., an EU Authorized Representative (EUAR), to fulfill the relevant regulatory requirements.
The following members are eligible to become European Generation:
a) Manufacturer or brand (if incorporated in the EU);
b) Importers incorporated in the EU;
c) an authorized representative of the manufacturer or the brand designated in writing and incorporated in the European Union;
d) Distribution service providers incorporated in the EU.
3. Provision of necessary documents and information
The trader is required to provide Eurotech Benelux with the necessary documents and information, including product technical documentation, CE marking certificates, test reports, product labels and instructions for use. Eurotech Benelux will fulfill its duties based on these documents and information and ensure compliance.
4. Displaying the logo of the EU authorized representative and the registered address
Displaying the EURO mark and its registered address on the goods or on the packaging of the goods, as required by EU regulations, to ensure traceability and accountability.

【Note】The address of the EU agent must be a valid, detailed, EU address that can contact the EU agent.
In addition, as required by the European Union's General Product Safety Regulation (GPSR), which will come into effect on December 13, 2024, the regulation's requirements for Euromed information include the following: brand name/registered trademark name/trademark, contact address, and email or website address.

Fifthly, there is no risk of Eurovision:
The new EU Regulation on the Safety of Goods, Market Regulation (EU) 2019/1020, requires that after July 16, 2021, merchants whose products carry the CE marking but cannot provide information about their EU agent will be found guilty of violating the law.
Relevant consequences include, but are not limited to:
1.Most of the products with CE marking entering the EU from July 16, 2021 onwards may be detained or returned by the Customs if there is no relevant information on the packaging of the products;
2. Cargoes that have entered the EU customs will be detained and destroyed due to the lack of information about the EU representative;
3. Goods already in circulation are at risk of complaints.
