U.S. patent filing fees will see a significant increase of up to 481 TP3T in January 2025, and U.S. trademark fees are expected to increase by up to 401 TP3T starting in October of this year.
According to the Notice, the USPTO has made comprehensive changes to its bidding fees, adding 11 new fees and eliminating 5 existing fees. Overall, most of the fees have increased.
This is also consistent with the approach taken by the USPTO in responding to the problem of examination backlogs caused by the significant increase in the number of trademark cases by increasing the price of trademark registrations, thereby reducing the number of trademark applications and lowering the rate of growth.

Increase in Regulatory Application Fee
Currently, there are two ways to apply for a U.S. trademark: standardized and non-standardized, and the fees are $250 per category (TEAS Plus) and $350 per category (TEAS Standard). The new draft proposes to adjust the fees to US$350/class, an increase of 40%, which means that the official fee for each trademark application will increase by about RMB720.
At the same time, the original Electronic Application System (TEAS) standard and Plus application fee will be eliminated.

Increase in additional handling charges
In addition, the U.S. Trademark Office intends to further increase the additional processing fee of $100 per category for cases with incomplete information in the application. Previously, only some cases that did not meet the criteria for a standardized application were required to pay the additional fee.

Increase in fee for evidence of intent to apply
The Intent to File Evidence of Use fee is scheduled to increase from $100 per category to $150 per category, an increase of 50%. This is the first increase in the fee since 2002.

Trademark Renewal and Oath Fees Increase
Trademark renewal and oath fees have also increased to varying degrees. Renewal fees have increased by $50 per category, oath fees have increased by $75 per category, and incontestability fees have increased by $50 per category, with increases ranging from 171 TP3T to 331 TP3T.

The cost of filing an exterior patent application has risen from $1,760 to $2,600, an increase of 481 TP3T.
