The Spanish government has officially passed the latest Royal Decree 993/2022, and the Spanish EPR will be enforced on January 16, 2023 officially. Sellers are required to provide the registration code of Spanish WEEE and Battery Law during customs clearance, and non-compliant sellers' goods will not be able to clear customs.
Spain EPR mainly includes: packaging, electrical and electronic equipment, and industrial oils, tires.
Spanish Packaging Law
Similar to Germany and France, any product that is sold into Spain needs to be registered under the Spanish Packaging Law, as almost all products come with packaging, and the obligation to recycle the packaging takes effect from the first product that the seller sells in Spain. The Spanish Packaging Code has a number of features that differ from those of Germany and France:
1、Spanish packing method has high recovery cost
Recycling costs in Spain are high because the Spanish packaging law is based on a minimum of 1 ton. Therefore, regardless of whether the seller has 1 kilogram or 1 ton of packaging waste per year, the current minimum recycling fee is €600 per year.
2. Glass packaging has a special recycling obligation.
The sale of products in glass bottles (packaged in cardboard boxes) through the e-commerce channel requires the inclusion of a separate recycling program to comply with the Spanish Packaging Law. Sellers of cosmetic products, alcohol and beverages need to pay special attention.
Spanish Battery Law
Sellers of batteries and products with built-in batteries also need to register for the Spanish Battery Law.
There are four main product categories in the Spanish Battery Method:

Spain WEEE
All sellers who manufacture and sell electrical and electronic products into Spain are required to register for Spanish WEEE.
Spain WEEE registration type:
①Heat exchange equipment (refrigerators, air conditioners, etc.)
②Screens, displays and equipment, including screens with a surface larger than 100cm² (monitors, laptops, etc.)
③Lamps (bulbs, etc.)
④Large equipment (washing machine, dishwasher, etc.)
⑤Small equipment (coffee maker, cell phone, etc.)
(6) Small computers and telecommunication equipment (all with external dimensions less than or equal to 50 centimeters) (printers, USB cables, etc.)

What are the consequences of not registering?
Failure to register with the Spanish EPR will result in the seller's non-compliant products not being able to clear customs.
Cross-border platforms like Amazon will also block your products and limit your sales.
The regulator imposed fines of up to €1.75 million, among other things.
