\/><\/h2>\n<h2><\/h2>\n<h2>\u5546\u6a19\u5ef6\u9072\u8a3b\u518a\u7684\u4ee3\u50f9:\u7b54\u6848\u6bd4\u4f60\u60f3\u7684\u56b4\u91cd<\/h2>\n<p><strong>\u5fc5\u9808\u63d0\u65e9\u5e03\u5c40,\u56e0\u70ba\u7f8e\u570b\u5546\u6a19\u63a1\u300c\u5148\u7533\u8acb\u5236\u300d,\u5ef6\u9072\u8a3b\u518a\u5c07\u9762\u81e84\u5927\u81f4\u547d\u98a8\u96aa<\/strong>:\u54c1\u724c\u88ab\u6436\u8a3b\u3001\u4fb5\u6b0a\u8ce0\u511f\u6700\u9ad83\u500d\u7f70\u5247\u3001\u96fb\u5546\u5e73\u53f0\u5f37\u5236\u4e0b\u67b6\u3001\u55aa\u5931\u5c08\u7528\u6b0a\u3002\u6839\u64daUSPTO\u7d71\u8a08,\u8d85\u904e60%\u7684\u5546\u6a19\u7cfe\u7d1b\u6e90\u81ea\u300c\u8a3b\u518a\u6642\u6a5f\u904e\u665a\u300d,\u53f0\u7063\u54c1\u724c\u4e3b\u82e5\u7b49\u5230\u7522\u54c1\u71b1\u8ce3\u624d\u7533\u8acb,\u5f80\u5f80\u5df2\u932f\u904e\u6700\u4f73\u4fdd\u8b77\u6642\u6a5f\u3002<\/p>\n<p>\u63d0\u65e9\u5e03\u5c40\u7684\u6838\u5fc3\u539f\u56e0\u5728\u65bc<strong>USPTO\u63a1\u300c\u5148\u7533\u8acb\u539f\u5247\u300d(First-to-File)<\/strong>,\u5373\u4f7f\u4f60\u5148\u4f7f\u7528\u5546\u6a19,\u5f8c\u7533\u8acb\u8005\u82e5\u6436\u5148\u8a3b\u518a\u6210\u529f,\u4f60\u5c07\u9762\u81e8\u4fb5\u6b0a\u6307\u63a7\u3002\u672c\u6587\u5c07\u6df1\u5ea6\u89e3\u67904\u5927\u81f4\u547d\u98a8\u96aa\u3001\u53f0\u7063\u54c1\u724c\u5e38\u8e29\u7684\u6642\u9593\u7d05\u7dda,\u4ee5\u53ca\u4f55\u6642\u8a72\u555f\u52d5\u7f8e\u570b\u5546\u6a19\u8a3b\u518a\u7684\u5be6\u52d9\u5224\u65b7\u6a19\u6e96\u3002<\/p>\n<hr \/>\n<h2>\u70ba\u4f55\u7f8e\u570b\u5546\u6a19\u5fc5\u9808\u300c\u6436\u5148\u8a3b\u518a\u300d?USPTO\u5148\u7533\u8acb\u5236\u5ea6\u89e3\u6790<\/h2>\n<p>\u7f8e\u570b\u5546\u6a19\u5236\u5ea6\u96d6\u540c\u6642\u627f\u8a8d\u300c\u4f7f\u7528\u57fa\u790e\u300d(Use in Commerce)\u8207\u300c\u610f\u5716\u4f7f\u7528\u300d(Intent-to-Use)\u5169\u7a2e\u7533\u8acb\u65b9\u5f0f,\u4f46\u5728\u6b0a\u5229\u6b78\u5c6c\u4e0a,<strong>USPTO\u63a1\u300c\u5148\u7533\u8acb\u539f\u5247\u300d\u4f5c\u70ba\u6838\u5fc3\u5224\u5b9a\u6a19\u6e96<\/strong>\u3002\u9019\u8207\u53f0\u7063\u300c\u5148\u4f7f\u7528\u4e3b\u7fa9\u300d\u5b58\u5728\u6839\u672c\u5dee\u7570,\u662f\u53f0\u7063\u54c1\u724c\u4e3b\u6700\u5e38\u8aa4\u5224\u7684\u95dc\u9375\u9ede\u3002<\/p>\n<p>\u6839\u64da\u7f8e\u570b\u5546\u6a19\u6cd5(Lanham Act) \u00a72(d) <a href=\"https:\/\/www.govinfo.gov\/content\/pkg\/USCODE-2011-title15\/html\/USCODE-2011-title15-chap22-subchapI-sec1052.htm\" target=\"_blank\" rel=\"noopener\">https:\/\/www.govinfo.gov\/content\/pkg\/USCODE-2011-title15\/html\/USCODE-2011-title15-chap22-subchapI-sec1052.htm<\/a>,\u82e5\u5169\u5546\u6a19\u53ef\u80fd\u9020\u6210\u6df7\u6dc6\u8aa4\u8a8d,<strong>\u7533\u8acb\u65e5\u671f\u8f03\u65e9\u8005\u4eab\u6709\u512a\u5148\u6b0a<\/strong>\u3002\u5373\u4f7f\u4f60\u5728\u5e02\u5834\u4e0a\u4f7f\u7528\u5546\u6a19\u591a\u5e74,\u82e5\u7af6\u722d\u5c0d\u624b\u6436\u5148\u5411USPTO\u63d0\u4ea4\u7533\u8acb,\u4f60\u7684\u5f8c\u7e8c\u7533\u8acb\u5c07\u56e0\u300c\u6df7\u6dc6\u53ef\u80fd\u6027\u300d(Likelihood of Confusion)\u88ab\u99c1\u56de\u3002<\/p>\n<h3>USPTO\u5148\u7533\u8acb\u5236\u76843\u500b\u6838\u5fc3\u7279\u5fb5<\/h3>\n<ol>\n<li><strong>\u7533\u8acb\u65e5\u512a\u5148<\/strong>: \u4ee5USPTO\u6536\u5230\u7533\u8acb\u6587\u4ef6\u7684\u65e5\u671f\u70ba\u6e96,\u975e\u5be6\u969b\u4f7f\u7528\u65e5\u671f<\/li>\n<li><strong>\u610f\u5716\u4f7f\u7528\u4fdd\u8b77<\/strong>: \u54c1\u724c\u88ab\u6436\u8a3b,\u539f\u5275\u8005\u53cd\u6210\u4fb5\u6b0a\u4eba<\/h3>\n<p><strong>\u6700\u5e38\u898b\u60c5\u5883<\/strong>: \u53f0\u7063\u54c1\u724c\u5728Amazon\/eBay\u92b7\u552e1-2\u5e74\u5f8c\u624d\u7533\u8acb\u5546\u6a19,\u537b\u767c\u73fe\u5df2\u88ab\u4ed6\u4eba\u6436\u8a3b\u3002<\/p>\n<p>\u4f9d\u64daUSPTO\u5546\u6a19\u5be9\u67e5\u7a0b\u5e8f\u624b\u518a(TMEP) \u00a71207.01 <a href=\"https:\/\/tmep.uspto.gov\/RDMS\/TMEP\/current#\/current\/d1e2.html\" target=\"_blank\" rel=\"noopener\">https:\/\/tmep.uspto.gov\/RDMS\/TMEP\/current#\/current\/d1e2.html<\/a>,\u5546\u6a19\u5be9\u67e5\u63a1\u300c\u5148\u7533\u8acb\u512a\u5148\u300d\u539f\u5247\u3002\u82e5\u7af6\u722d\u5c0d\u624b\u3001\u524d\u54e1\u5de5\u6216\u60e1\u610f\u6436\u8a3b\u8005\u5148\u884c\u7533\u8acb,\u5373\u4f7f\u4f60\u662f\u54c1\u724c\u539f\u5275\u8005,\u4ecd\u53ef\u80fd:<\/p>\n<ul>\n<li><strong>\u5f8c\u7e8c\u7533\u8acb\u88ab\u99c1\u56de<\/strong>:
